Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and The Lineup Is LLC ("we," "us," or "our") governing your use of The Lineup Is mobile application, our website at www.thelineup.is, and related services (collectively, the "Service").
By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Your Account
To use the Service, you must sign in with Sign in with Apple or Google Sign-In. You are responsible for maintaining the security of your Apple ID or Google account and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without your authorization.
You may delete your account at any time from within the App's Settings.
3. Subscriptions and Billing
3.1 Free and Pro Tiers
The Service is offered in a free tier and a paid "Pro" tier. The features available in each tier are described in the App and may change over time at our discretion.
3.2 Pricing and Auto-Renewal
The Lineup Is Pro is available as an auto-renewing subscription through Apple's App Store on the following terms:
- Monthly subscription — $4.99 USD per month (or local equivalent)
- Annual subscription — $29.99 USD per year (or local equivalent), with a 7-day free trial for new subscribers
Prices may vary by region and are displayed in your local currency at the time of purchase.
Auto-renewal terms (required by Apple):
- Payment will be charged to your Apple ID account at the confirmation of purchase.
- Your subscription will automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
- You can manage your subscription and turn off auto-renewal at any time by going to your Apple ID Account Settings after purchase.
- No cancellation of the current subscription is allowed during an active subscription period; cancellation takes effect at the end of the current period.
3.3 Free Trials
If you are eligible for a free trial of the annual subscription, you will not be charged during the trial period. If you do not cancel at least 24 hours before the trial ends, the subscription will begin and you will be charged the annual subscription price. Eligibility for a free trial is determined by Apple and is typically limited to one trial per Apple ID.
3.4 Refunds
All purchases are processed by Apple. Refund requests must be made directly to Apple through your App Store account. We do not process refunds directly.
3.5 Price Changes
We may change subscription prices from time to time. Price increases will take effect no earlier than 30 days after notice is provided to you, and will apply at your next renewal. If you do not accept a price change, you may cancel your subscription before it takes effect.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Reverse-engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by applicable law
- Access the Service through automated means (bots, scrapers) or interfere with the Service's operation
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Resell, rent, or redistribute access to the Service or its content
- Use the Service to harass, harm, or infringe the rights of others
- Circumvent any access or usage limits (for example, by creating multiple accounts to bypass free-tier limits)
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Content and Intellectual Property
5.1 Our Content
The Service, including the importance algorithm, AI-generated narratives, visual design, typography, and all other content we create, is owned by The Lineup Is LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms.
You may not copy, modify, distribute, sell, or create derivative works based on the Service or its content without our prior written permission.
5.2 Third-Party Data
The Service displays sports data (scores, schedules, standings, broadcast information) sourced from third parties, including ESPN. This data is the property of its respective owners and is provided for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of third-party data.
5.3 AI-Generated Content
The App generates short narratives describing games using AI models (currently Gemini, operated by Google). These narratives are generated based on public sports data and are intended to provide context and commentary.
You acknowledge that AI-generated content:
- May contain inaccuracies, omissions, or outdated information
- Is not professional analysis or advice of any kind
- Should not be relied on for betting, wagering, or financial decisions
- Is generated algorithmically and does not represent human editorial judgment
We make reasonable efforts to ground AI narratives in verified data, but we do not guarantee their accuracy.
5.4 Trademarks
"The Lineup Is" and the associated logos and wordmarks are trademarks of The Lineup Is LLC. Team names, league names, and other sports-related marks displayed in the App are the property of their respective owners and are used for informational purposes only. We are not affiliated with, endorsed by, or sponsored by any sports league, team, broadcaster, or governing body.
6. No Streaming or Betting
The Service does not stream games and does not facilitate betting, wagering, or gambling of any kind. Broadcast information is provided for reference only. Any decisions you make based on information displayed in the App — including decisions about what to watch, where to watch, or how to spend your time or money — are your own.
7. Notifications, Live Activities, and Widgets
The Service offers push notifications, Live Activities, and widgets through Apple's operating system features. You may enable or disable these features at any time in iOS Settings or within the App. We do not guarantee the timing, delivery, or accuracy of notifications and alerts.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any content provided through the Service, including scores, game data, narratives, or rankings.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, The Lineup Is LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOST GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.
Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless The Lineup Is LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your use of the Service, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we cease operating the Service.
You may stop using the Service at any time by deleting your account in the App. Deletion of your account does not automatically cancel your Pro subscription — you must cancel your subscription separately through your Apple ID settings.
Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.
12. Changes to the Service
We may modify, suspend, or discontinue the Service or any part of it at any time. We will provide reasonable notice of material changes that affect existing Pro subscribers.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service shall be resolved in the state or federal courts located in Orange County, California, and you consent to the jurisdiction of those courts.
If you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protection laws, nothing in this section limits your rights under those laws.
15. Apple-Specific Terms
If you downloaded the App from the Apple App Store, the following additional terms apply:
- These Terms are between you and The Lineup Is LLC, not with Apple. Apple is not responsible for the App or its content.
- Your license to use the App is limited to use on an Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, consumer protection claims, or intellectual property claims.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you.
16. Miscellaneous
These Terms constitute the entire agreement between you and The Lineup Is LLC regarding the Service and supersede any prior agreements. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our written consent; we may assign them freely.
